Terms and Conditions

1. The undersigned (hereinafter called Applicant) hereby applies for membership in and agrees to purchase electric energy from New Enterprise Rural Electric Cooperative, Inc., New Enterprise, PA (thereafter called the Cooperative) through the service connection at the property listed above, and any additional locations as per By-Law regulation in the New Enterprise REC area.

2. Applicant, by becoming a member, assumes no personal liability or responsibility for any debts or liabilities of the Cooperative, and it is expressly understood that under the law his private property cannot be attached for any such debts or liabilities.

3. Applicant will cause his premises to be wired in accordance with wiring specifications approved by the Cooperative.

4. Applicant agrees to comply with and be bound by the Articles of Incorporation, the By-Laws of the Cooperative, any amendments, thereto, and such rules and regulations as may be adopted from time to time by the Board of Directors and/or the Cooperative.

5. Applicant agrees, when electric energy becomes available, that all electric energy used on the premises described above will be purchased from the Cooperative and will be paid for monthly or in any other manner in accordance with By-Law and/or Board regulation at rates to be determined by the Board from time to time in accordance with By-Laws of the Cooperative; provided, however, that a minimum bill be paid as established by the approved rate and the approved payment procedures regardless of kilowatt hours consumed as approved by the Board of Directors.

6. Applicant agrees:

     a. To make payment of such fees as is designated in the By-Laws in respect to membership, it being expressly understood that no interest will be paid on membership fees.

     b. That any fees specified in section (a) shall be refundable except in the event that the applicant fails to fulfill his contract with the Cooperative as provided in the By-Laws.

7. Applicant agrees to deposit with the Cooperative such consumer deposits as is required by the Rules and Regulations of the Cooperative, it being expressly understood that such deposits shall be non-interest bearing and that any portion of said deposit not applied to payment of bills due the Cooperative shall be refunded to applicant upon termination of service.

8. The acceptance of this application by the Cooperative shall:

     a. Constitute a contract for electric service between Applicant and the Cooperative which shall continue in force until cancelled by at least 10 homes written notice by either party to the other.

     b. Constitute an acceptance of applicant to membership in the Cooperative with such rights and liabilities as are specified in the By-Laws of the Cooperative, provided, however that said membership shall terminate when applicant ceases to purchase electric energy from the Cooperative at the service location or locations herein agreed upon.

9. CONTINUITY OF SERVICE RESOLUTION

Below is the Continuity of Service resolution adopted by the Board of Directors of the New Enterprise Rural Electric Cooperative, Inc. at the May meeting 1973:

Resolved that this regulation shall be effective immediately and shall be applicable in respect to all service furnished by the Cooperative to its members and non-members alike; shall be a part of the condition under which service is received by such members and non-members.

“Cooperative will use reasonable diligence to maintain uninterrupted service, but does not guarantee a constant or regular supply of electrical energy and shall not be liable for damage due to variations or cessations in such supply. Members should give immediate notice at the office of the Cooperative of any interruptions or irregularities in service or any known trouble, defect or accident to supply. Cooperative may interrupt service to any member or members for the protection of life or property, for its system for the general good of the service or safety of the public, or when in Cooperative’s sole judgment such interruption will prevent or alleviate an emergency threatening the integrity of its system, or will aid in the restoration of service. Circumstances permitting, Cooperative will give reasonable notice of any contemplated suspension. Should service be interrupted for any of the above reasons, or should service fail by reason of any accident, strike, legal process, governmental interference, or any cause whatsoever beyond its control, the Cooperative shall not be liable for damages, direct or consequential, resulting therefrom.”

10. Applicant, if accepted as a member of the Cooperative, hereby authorizes the Cooperative, upon termination of his membership in any manner to cancel said membership.
